City of Newcastle (CN) is proposing to enter into a Planning Agreement for the development at 30 and 31 Vista Parade, Kotara with the owner of the site, Trustees Diocese of Maitland-Newcastle.

The development application for the site (DA2019/00966) was refused by the Hunter & Central Coast Regional Planning Panel on 29 March 2021 based on the proposed development's impact on the surrounding road network.

The development application is subject to a Class 1 Appeal in the Land and Environment Court.

The draft Planning Agreement proposes the dedication of approximately 90m2 of land to CN to widen Vista Parade, with the applicant to undertake the road widening works and the construction of a roundabout and intersection upgrades at the intersection of Princeton Avenue and Vista Parade. The works include associated infrastructure, footpaths, signage and bus stop relocation.

These works are required to manage the traffic impacts of the proposed development at the site.

The draft Planning Agreement was endorsed by Council for public exhibition at its meeting on 22 November 2022.


What is a Planning Agreement?

A Planning Agreement (PA) is a legal agreement entered into by a planning authority, such as City of Newcastle, and an applicant. Under a Planning Agreement, the applicant agrees to provide or fund community benefits such as public amenities, public services, affordable housing, transport, or other infrastructure.


What is an Explanatory Note?

Planning Agreements must be accompanied by an Explanatory Note to assist the public in understanding the Planning Agreement. An Explanatory Note will outline what the Planning Agreement is proposing, how it delivers public benefit, and why it is acceptable and within the public interest.
