Overview

A planning proposal was publicly exhibited to list the ‘residence’ at 22 Victoria Street, Mayfield (the site) as a local heritage item in the Newcastle Local Environmental Plan 2012 (NLEP 2012).


Background

An interim heritage order (IHO) over 22 Victoria Street Mayfield was made on 15 March 2024.

City of Newcastle (CN) then engaged an independent heritage consultant to prepare a heritage assessment. The assessment found the dwelling at 22 Victoria Street, Mayfield reaches the local heritage significance threshold.

We prepared a planning proposal to list the dwelling in schedule 5 of the NLEP 2012. On 25 June 2024, Council resolved to commence the planning proposal process. The planning proposal was forwarded to the Department of Planning, Housing and Infrastructure (the Department) for a Gateway determination under Section 3.34 of the EP&A Act. A Gateway determination was issued on 7 August 2024. This allows the planning proposal to commence to public exhibition. It also requires consultation with Heritage NSW.

The planning proposal was placed on public exhibition from Monday 16 September to Monday 14 October 2024.

All submissions received during public exhibition were reviewed and considered.

At the Ordinary Council Meeting on 10 December 2024, Council unanimously voted to endorse the planning proposal prepared under Section 3.33 of the Environmental Planning and Assessment Act 1979 to amend Newcastle Local Environmental Plan 2012 to create a new heritage item at 22 Victoria Street, Mayfield.

The planning proposal was then forwarded to the Department of Planning, Housing and Infrastructure and finalised. View the amendment to the Newcastle Local Environmental Plan 2012 (Amendment No 55) (2025 EPI 364).
